Terms and conditions of sale

1. Scope

These terms and conditions apply to all orders placed in the javols.net online shop with Javols SA, Route du Village 3, 1421 Grandevent, Switzerland ("Javols SA"), in the version in force at the time of the order.

Horses are not sold online; their sale is subject to a separate written contract to which these terms do not apply.

2. Contract

The products shown on the website are not a binding offer. By submitting your order you make an offer to buy. The contract is concluded when Javols SA confirms your order by email. Javols SA may refuse an order, in particular if an item is out of stock or the price is obviously wrong; any payment already made is then refunded.

3. Prices

Prices are in Swiss francs (CHF). Javols SA is not registered for VAT: no VAT is charged on its prices or shown on its invoices. Shipping costs are shown before you submit your order.

4. Payment

Payments are processed by the provider Stripe. Depending on your country and the amount, Javols SA accepts credit and debit cards, Apple Pay, Google Pay, TWINT (in CHF), Klarna and PayPal. Javols SA never has access to your card details.

5. Delivery

Javols SA delivers to Switzerland and Liechtenstein from its stock in Switzerland. Delivery times are estimates. Risk passes to you on delivery.

6. 14-day right of withdrawal

You may withdraw from your purchase without giving any reason within 14 days of the day on which you (or a third party you designated) take possession of the goods. This right is granted to all customers.

To exercise it, inform Javols SA of your decision with a clear statement before the deadline, for example by email to elise@javols.net. You may use the model form below, but it is not mandatory.

Send the goods back without undue delay and no later than 14 days after informing Javols SA of your withdrawal. You bear the direct cost of returning the goods. You are only liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Javols SA refunds all payments received, including standard delivery costs, no later than 14 days after receiving your withdrawal, using the same means of payment. Javols SA may withhold the refund until it has received the goods back or you have supplied evidence of having sent them.

Exceptions: the right of withdrawal does not apply to goods made to your specifications or clearly personalised, nor to sealed goods unsuitable for return for hygiene reasons once unsealed.

7. Warranty

The statutory warranty applies. For consumers, the period is two years from delivery (art. 210 Swiss Code of Obligations). If an item is defective, contact Javols SA with a description and photos: a repair, a replacement or a refund will be offered.

8. Liability

Javols SA is only liable for damage caused intentionally or through gross negligence, to the extent permitted by law. Liability for personal injury and product liability remain unaffected.

9. Data protection

How your data is processed is described in the privacy policy.

10. Applicable law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The mandatory consumer protection rules of your country of residence remain reserved. The place of jurisdiction is Grandevent (Canton of Vaud), subject to mandatory places of jurisdiction in favour of consumers.

Javols SA is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

11. Customer reviews

Reviews on the product pages come only from customers who bought the item: after shipping, and only if the customer asked for it when ordering, Javols SA sends a personal link tied to their order. No review can be posted without this link. Every review is read before publication. Positive and negative reviews alike are published; only reviews that are unlawful, abusive, unrelated to the item or that contain personal data are rejected. Javols SA does not pay for reviews or offer anything in return. Reviews are shown newest first, those written in the page's language first; the average rating is computed over the reviews shown.
